Terms of Service

1. Introduction and Acceptance of Terms

Welcome to Somnial (“the App”), a mobile application that generates personalised AI-powered stories for bedtime reading, commuting, and leisure. Somnial is operated by Ladder of Life Pte. Ltd. (UEN: 202550589K), a company incorporated in Singapore (“we”, “us”, “our”, “Company”).

By downloading, installing, accessing, or using Somnial, you (“you”, “your”, “User”) agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

If you do not agree to these Terms, you must not download, install, or use the App. If you are using the App on behalf of a minor child, you accept these Terms on their behalf and are responsible for their use of the App.

2. Description of Service

Somnial is a mobile application that allows users to:

Generate original, personalised short stories using artificial intelligence based on user-selected parameters (genre, mood, ending type, story length, and language difficulty)
Save favourite stories locally on their device
View a history of previously generated stories
Share generated stories with others

Story content is generated by Anthropic PBC’s Claude AI model via our secure proxy server. Each story is uniquely generated in real time based on your inputs.

3. Eligibility

3.1 Age Requirements

You must be at least 13 years of age to use Somnial
If you are between 13 and 18 years of age, you may only use the App with the consent and supervision of a parent or legal guardian
Users under 13 are not permitted to use the App

3.2 Children’s Content

The “Little Ones” difficulty setting is designed for stories to be read by parents or guardians to children aged 3–5 years old
This feature is intended to be operated by an adult, not directly by a young child
Parents and guardians are solely responsible for supervising their child’s exposure to content generated by the App

4. Free Trial and Subscription

4.1 Free Trial

New users receive a 24-hour free trial upon first launch of the App
The free trial provides full, unlimited access to all features of Somnial
No payment is required during the free trial period
At the end of the 24-hour free trial, continued use of the App requires a paid subscription

4.2 Somnial Premium Subscription

Following the free trial, Somnial Premium is available at SGD $4.99 per month (or local currency equivalent as determined by Apple Inc.)
The subscription is billed monthly through your Apple App Store account
Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date
Payment will be charged to your Apple ID account at confirmation of purchase

4.3 Managing and Cancelling Your Subscription

You may manage or cancel your subscription at any time through your Apple ID account settings
Go to: Settings → [Your Name] → Subscriptions on your iPhone
Cancellation takes effect at the end of the current billing period — you will retain access until that date
We do not offer refunds for partial subscription periods except as required by applicable law or Apple’s own refund policies

4.4 Price Changes

We reserve the right to change subscription pricing with reasonable notice
Price changes will be communicated through the App or App Store listing
Continued use of the App after a price change constitutes acceptance of the new price

4.5 Apple’s Role

All subscription transactions are processed by Apple Inc.
Apple’s App Store Terms of Service govern all purchase transactions
Any billing disputes should be directed to Apple Support

5. Acceptable Use

5.1 Permitted Use

You may use Somnial solely for personal, non-commercial purposes in accordance with these Terms.

5.2 Prohibited Use

You agree not to use Somnial to:

Request, generate, or distribute content that is sexually explicit, pornographic, or obscene
Request, generate, or distribute content that promotes, glorifies, or facilitates violence, self-harm, suicide, or harm to others
Request, generate, or distribute content that is hateful, discriminatory, or harassing based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
Request, generate, or distribute content that facilitates or promotes illegal activities
Attempt to circumvent, disable, or interfere with the App’s content filtering system
Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
Use the App in any manner that could damage, disable, overburden, or impair our servers or networks
Use automated scripts, bots, or other automated means to access or use the App
Resell, redistribute, or commercially exploit story content generated by the App without our prior written consent
Attempt to extract, reproduce, or distribute our API proxy infrastructure or server-side logic
Use the App in any way that violates applicable laws or regulations in Singapore or your jurisdiction

5.3 Content Filter

Somnial operates a server-side content filter that screens story requests for inappropriate content. Attempts to circumvent this filter are a violation of these Terms and may result in immediate termination of your access to the App.

6. Intellectual Property

6.1 Our Intellectual Property

The App, including its design, interface, branding, logo, name “Somnial”, and underlying technology, is owned by Ladder of Life Pte. Ltd. and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your personal use in accordance with these Terms.

6.2 AI-Generated Story Content

Stories generated by the App are created by Anthropic PBC’s Claude AI model. With respect to AI-generated content:

We make no claim of copyright ownership over individual stories generated by the App
You acknowledge that AI-generated content may not be protected by copyright under applicable law
You may use stories generated for your personal, non-commercial enjoyment
You may share generated stories with others provided you do not misrepresent the origin of the content or claim human authorship
Commercial exploitation of generated story content is not permitted without our prior written consent

6.3 Anthropic’s Intellectual Property

The AI model used to generate stories is proprietary to Anthropic PBC. Your use of the App is subject to Anthropic’s usage policies, available at https://www.anthropic.com/legal/usage-policy.

7. Disclaimers and Limitation of Liability

7.1 AI-Generated Content Disclaimer

Stories generated by Somnial are produced by an artificial intelligence model. We make no representations or warranties regarding:

The accuracy, completeness, or appropriateness of generated content
The suitability of generated content for any particular purpose or age group
The consistency or quality of generated stories

You acknowledge that AI-generated content may occasionally be unexpected, inconsistent, or not fully aligned with your preferences. We are not responsible for the specific content of any individual story generated by the AI model.

7.2 “Little Ones” Content Disclaimer

While the “Little Ones” difficulty setting is designed to generate age-appropriate content for young children, AI-generated content cannot be guaranteed to be entirely suitable for all children in all circumstances. Parents and guardians are strongly encouraged to review generated content before reading it to their children. We accept no liability for any content generated under this setting that a parent or guardian deems inappropriate.

7.3 Service Availability

We do not guarantee that the App will be available at all times or free from errors, interruptions, or bugs. Story generation depends on third-party services (including Anthropic’s API) that are outside our control. We are not liable for any interruption to the service caused by third-party providers.

7.4 Limitation of Liability

To the maximum extent permitted by applicable law:

The App is provided on an “as is” and “as available” basis without warranties of any kind
We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement
In no event shall Ladder of Life Pte. Ltd., its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App
Our total liability to you for any claims arising out of or related to these Terms or the App shall not exceed the amount you paid us in subscription fees in the three months preceding the claim

8. Indemnification

You agree to indemnify, defend, and hold harmless Ladder of Life Pte. Ltd. and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

Your use of the App in violation of these Terms
Your violation of any applicable law or regulation
Any content or story parameters you submit through the App that violates these Terms or any third-party rights

9. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

10. Third-Party Services

The App integrates with third-party services including Anthropic PBC, Railway, RevenueCat, and Apple Inc. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, content, or availability of any third-party services.

11. Modifications to the App and Terms

11.1 Changes to the App

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

11.2 Changes to These Terms

We reserve the right to update these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this document and may notify you through the App. Your continued use of the App after any changes to these Terms constitutes your acceptance of the updated Terms.

12. Termination

12.1 Termination by You

You may stop using the App and cancel your subscription at any time through your Apple ID account settings.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to the App immediately and without notice if:

You violate any provision of these Terms
We are required to do so by law or a court order
We reasonably believe your use of the App poses a risk to us, other users, or third parties

12.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and limitation of liability) shall survive.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.

13.2 Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the App, the parties shall first attempt to resolve the dispute through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may refer the dispute to the Singapore Mediation Centre for mediation before commencing any legal proceedings.

13.3 Jurisdiction

Subject to the above, you agree to submit to the exclusive jurisdiction of the courts of Singapore for the resolution of any disputes arising out of or relating to these Terms or the App.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ladder of Life Pte. Ltd. with respect to the App and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
